FEES

All cases and clients are different. As a result, different approaches can be necessary to achieve the desired result. At Diakiw Law, we offer several different models to provide clients with the most appropriate method of payment for them and the case at hand.

Consults

All initial 20-minute consults with the firm will be complimentary. If a further consult is requested, the fee will be charged on an hourly basis.

The consult is not a retainer and legal advice will be limited.

If the matter cannot be handled by Diakiw Law, we will either refer you to another lawyer or recommend the LSO’s referral service.

Types of Fee Structures

Hourly Billing

We offer hourly rates for all employment matters for both employers and employees. These retainers are accepted with an upfront fee to secure the legal services. This fee ensures that the lawyer will be available to provide advice, services, or representation as needed.

Block Fee Billing

Block fee billing is available for the following services (scaled on complexity):

  • Employment Contract Drafting

  • Workplace Policy Drafting

  • Termination Package Drafting

  • Policy Audits

Life and Disability Claims Only - Contingency Billing

This type of billing provides greater access to justice for people who cannot afford to pay for a retainer. Contingency agreements are subject to the Law Society of Ontario’s Standard Form Contingency Agreement which can be found online, but will also form part of the retainer agreement.

At this time, our contingency agreement for life and disability matters is 30% of the recovered settlement. If nothing is recovered at the time of settlement, then nothing is paid to the firm for the fees. Contingency agreements are only available where damages are sought against another party.

While there are occasions where the firm will suffer a loss, other times the matter may resolve quickly, and the fees paid to Diakiw Law may be greater than under an hourly structure.

Employee - Contingency Billing

On a limited basis, Diakiw Law may offer deferred billing in accordance with legislative requirements. These operate similarly to hourly retainers, with payment deferred to the resolution of the matter. These are not available on all matters.
